New York State Judge Bans Fantasy Football and Daily Fantasy Sports
Fan Duel voluntarily shut down their New York tenancy some time ago, but Draft Kings kept operating within the state. Following the decision, DK stated that they will appeal and seek an immediate stay of the ruling.
Their argument is that DFS is a game of skill and not a game of chance. They’re only collecting entry fees and not wagers, so it could not be considered betting. Justice Mendez however, saw the situation differently and granted an injunction to prevent Fan Duel and Draft Kings from operating their websites within the state.
Should the appeal fail, this will mark New York as the seventh state where Fantasy Football and DFS have been officially banned.
